These Terms & Conditions (“Terms”) govern your access to and use of this website (the “Site”), your purchase of products from our online shop, and any quote, installation, maintenance or related service we provide (together, our “Services”). By accessing the Site, creating an account, placing an order or accepting a quote, you agree to these Terms. If you do not agree, please do not use the Site or our Services.
We may update these Terms from time to time. The version that applies to your purchase or engagement is the version published when you placed your order or accepted your quote. The current version is always available on this page, with the “last updated” date shown above.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (ACL) or any other law that cannot lawfully be excluded. Where a provision of these Terms would otherwise do so, it does not apply to you to that extent.
The Site and Services are provided by Bioni Security & Electrical Pty Ltd (ABN 86 628 597 946) (“we”, “us”, “our”), of 21B / 65-75 Captain Cook Drive, Caringbah NSW 2229. If you submit content to us (for example a review, enquiry, photo or site plan), you confirm you are entitled to provide it and you grant us a non-exclusive, royalty-free licence to use it for the purpose of providing and promoting our Services. You must not submit content that is unlawful, misleading, defamatory or infringes another person’s rights. We may decline, edit or remove content at our discretion. Reviews must reflect a genuine customer experience.
All content on the Site — including text, graphics, logos, layout, images and code — is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable licence to access and use the Site for its intended purpose. You may not copy, reproduce, republish or commercially exploit any part of the Site without our prior written consent. “Bioni” and our logos are our trade marks; third-party brand names and trade marks remain the property of their respective owners.
We take care to keep product information, specifications, images and pricing accurate, but some content is supplied by manufacturers and may contain errors or change without notice. Information on the Site is general in nature and is not professional, security or electrical advice for your specific site. To the extent permitted by law, we do not warrant that the Site will be uninterrupted, error-free or secure, or that content is complete or current. You rely on Site content at your own risk; for advice tailored to your premises, request a quote or contact us.
Your order is an offer to buy. A binding contract of sale is formed only when we accept your order — which occurs when we send you an order or payment confirmation, or dispatch the goods, whichever is first. We may decline or cancel an order (for example where goods are unavailable, where there is a pricing or description error, where we suspect fraud or misuse, or where we cannot verify your details); if we do, we will refund any payment for the cancelled items in full.
Card payments are processed by Stripe through its secure hosted checkout. We do not receive or store your full card details — see our Privacy Policy. You confirm you are authorised to use the payment method. We may also offer invoiced or quote-based payment for certain orders and for installation work, on the payment terms stated on the relevant quote or invoice.
Delivery, freight and Click & Collect are described on our Shipping & Returns page. Title to goods passes to you on full payment; risk passes on delivery to you or your nominated address, or on collection. Delivery timeframes are estimates and are not guaranteed.
Your rights to repair, replacement or refund, our returns (RMA) process and any change-of-mind policy are set out on the Shipping & Returns page, which forms part of these Terms.
Where you purchase or have us install CCTV, access control, intercom or other surveillance or recording equipment, you are responsible for using it lawfully — including complying with the Surveillance Devices Act 2007 (NSW), the Workplace Surveillance Act 2005 (NSW), privacy laws and any signage, notification or consent obligations that apply to your premises and circumstances. We can advise on compliant configuration, but lawful operation of the system after handover is your responsibility.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with a service you are entitled to cancel your service contract and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract. For goods, you are entitled to a repair, replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage; and to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
In addition to your non-excludable consumer guarantees:
Any voluntary warranty we give is in addition to, and does not limit, your rights under the Australian Consumer Law.
Nothing in this clause limits your rights under the Australian Consumer Law or our liability for matters that cannot lawfully be limited. Subject to that:
Our liability is reduced to the extent your acts or omissions (or those of a third party) caused or contributed to the loss.
To the maximum extent permitted by law, you agree to indemnify us against loss, damage, cost or expense we reasonably incur arising from your breach of these Terms, your misuse of the Site or any product, or your unlawful use of surveillance or security equipment.
The Site may link to third-party websites and we supply third-party branded products. We do not control and are not responsible for third-party websites or content, and your dealings with them are at your own risk. Third-party products are covered by the relevant manufacturer’s terms and warranty in addition to your consumer guarantees.
We handle personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). By using the Site and Services you acknowledge that policy.
We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control (including supply shortages, carrier delays, fire, flood, severe weather, outages, industrial action, pandemic or government action). We will take reasonable steps to minimise any delay.
